Kash Heed / Lucy Scientific / Richmond SCS Motion: Primary-Source Evidence Review

Published: · Last reviewed:

Review date: 2026-09-14
Method: each item was checked against the original document, downloaded or opened directly. Sources include SEC EDGAR filings and full-text search, City of Richmond council minutes (HTML/PDF), the scanned BCSC filing (OCR'd page by page), the Cullen Commission PDF, House of Commons HESA transcripts, and the original media reports.

1. Overall findings

  1. Most facts in the original draft are supported by primary documents. Dates, vote results, motion text, Lucy's appointment announcement, the National Green BioMed (NGB) payment structure and paragraph 64 of the Cullen submission were all verified.
  2. Nine items need correction or softer wording, three of which are citation errors (a quotation that does not match the source, or the wrong source cited). See Section 2.
  3. The draft omitted several pieces of balancing evidence favourable to the subject. Examples:
    - Lucy's safer-supply market language already appeared in its January 2022 S-1, more than a year before it hired Heed and before Heed was elected;
    - FOI emails show VCH Medical Health Officer Dawar initially saw the motion as a "great opportunity" to introduce eOPS, and that the Premier's Office later directed VCH to issue a statement;
    - Heed says he clarified his relationship with Lucy twice at Council;
    - Heed's October 2023 motion called for secure care, which is not harm reduction.

2. Item-by-item verification

# Section of draft Verification result Required change
1 2008: Hedy Fry cites Heed's support for Insite at the Health Committee ✅ Accurate. HESA (39-2), Meeting No. 32, 2008-05-29. Fry: "He fully supports Insite's results… a decrease of public harm and an increase in public order." State that this is Fry's characterization, not Heed's own testimony. Link to the official ourcommons.ca transcript.
2 2012: Heed joins Stop the Violence BC, calling for cannabis legalization, regulation and taxation ⚠️ Partly verified. CTV/Canadian Press (2012-10-18) reported "MLA Kash Heed calls for legalization of pot" and that he had joined the grassroots legalization campaign. No original Heed quote was found for the specific "regulation, taxation, prohibition has failed" wording. Cite the CTV 2012-10-18 report. Attribute "regulate and tax" to Stop the Violence BC's platform, not to Heed.
3 Cullen Commission, para. 64 ✅ Accurate: "Mr. Heed formed a consulting company that provided, in part, consulting services advising companies on drug policies (pg. 44-45)." This is the Final Written Submissions filed by Heed's counsel, summarizing his 2021-04-30 testimony. Describe it as "final written submissions filed on Heed's behalf."
4 2014 Global News: consulting for BC and Ontario medical-cannabis companies ✅ Accurate (2014-05-16). The report says he "announced… his plans to advise B.C. and Ontario companies." CBC (2014-05-17) says he was "now working as a consultant." Change "had already begun" to "announced he would advise," or also cite CBC.
5 NGB fees, bonus and options ✅ All amounts verified (BCSC-filed Offering Memorandum dated 2016-02-10, OCR'd page by page). Four details need correcting; see right-hand column. ① The document names only "Heed Consultants Ltd.", not Kash Heed. Independent sourcing is needed to connect the two (see Section 3, S1/S2). ② The bonus trigger is described inconsistently: Item 3 of the memorandum says "pre-inspection stage"; the financial-statement notes say "security clearance stage". Report both. ③ The options were "agreed to grant", and the notes state "Final terms of the options are yet to be finalized"; the company had no formal option plan. Do not write "entitled to acquire", and there is no evidence the options were granted or exercised. ④ Unpaid at 2015-12-31: $27,000 ($20,750 at end of 2014).
6 2018 GrowX/Yuntone transaction announcement ✅ Accurate (2018-05-07): "Mr. Kash Heed provides GrowX with valuable insight into the way government is proceeding with legalization." Title: "Proposed Director of the Resulting Issuer." Keep "Proposed." Whether the transaction closed and Heed became a director is unverified; check SEDAR+/TSXV.
7 CannX 2018 conference abstract ✅ Accurate. The abstract calls Heed "a long-time drug policy reform advocate, and the founder and chief operating officer of GrowX Global" who will "explain his company's support for this research project." Replace with the public PMC link (the Karger link is blocked by Cloudflare). Keep the "long-time drug policy reform advocate" description; it supports the finding that his positions preceded his business interests.
8 CityNews 2022-12-14, "a suite of safe supply" ✅ Quotation accurate. ⚠️ "Safer drugs, addiction medicine, access to psychedelics, recovery" is the reporter's paraphrase, not Heed's words. The report identifies Heed as "former Commanding Officer of VPD's Drug Unit."
9 Lucy's 2023-02-16 application to add controlled substances ❌ Wrong source. The SEC Exhibit 99.1 press release names only "cocaine and heroin, among others" and contains no full list. The full list is in the 10-Q (filed 2023-03-17) and 10-K (filed 2023-10-13), 15 substances: coca leaves, ketamine, methamphetamine, methadone, buprenorphine, diacetylmorphine (heroin), opium, thebaine (spelled "thenaine" in the filing), cocaine, fentanyl, hydromorphone, oxycodone, hydrocodone, morphine, codeine (spelled "codine"). The draft omitted coca leaves, thebaine and codeine. The press-release line "hopes to supply safe access programs in the future" is accurate.
10 10-K says safer supply may expand its market ✅ Quotation accurate. ⚠️ Key context omitted: the same passage already appeared in the 2022-01-21 S-1, before Heed's election (2022-10) and hiring (2023-03). The 10-K also says SSPs "have not been used to prescribe medicinal psychedelics… and may never be used for this purpose." Lucy's thesis concerned psychedelics, not opioid safe supply.
11 Pramantha announcement: "three interconnected business lines" ⚠️ Over-interpretation. The announcement concerns US and Canadian federal funding for "domestic drug manufacturing" in response to "shortages of essential medications," with no mention of harm reduction or safe supply. It is also not an SEC filing (EDGAR search for "Pramantha" returns 0). Delete the "three interconnected lines" framing; describe only what the announcement says.
12 Lucy's announcement hiring Heed (2023-03-29) ✅ Facts accurate, but the quotation is wrong. The release says "navigate Canada's rapidly evolving drug policy landscape and growing budget focused on mental health and safe-supply programs." The draft put "mental-health and safe-supply programs budgets" in quotation marks, which is not the original wording. Quote verbatim. Add: Lucy's SEC filings never mention Heed (EDGAR full-text searches for "Heed," "Kash" and "special advisor" all return 0), and the release disclosed no compensation.
13 2023-06-19 VCH briefing ✅ Accurate. Heed attended; the eight topics presented by Dawar and Barclay match the draft. The minutes record no questions and answers. None.
14 2023-06-28: Heed invites Felicella ✅ Accurate: "the former cop asking the former robber to help educate the City of Richmond on addictions and homelessness." The BCCSU page is only a republished excerpt; the original is Richmond News (Maria Rantanen). Cite the original. Add: at the 2024-02-05 committee meeting, a resident read Felicella's letter supporting an SCS (recorded in the minutes).
15 Global News 2024-02-15: "last summer" doctor conversation ✅ Accurate. Full quote: "the conversation we had with the medical doctor last summer was quite the opposite, where in fact she said we could look at it." Add "she" (a female doctor). In the same report Heed attributed VCH's reversal to the Premier's political considerations ("flip-flop"). The FOI evidence must be added (Section 3, S4). Do not assume the doctor was Dawar.
16 October 2023 secure-care motion ✅ Accurate. Notice was given on 2023-09-30; the motion was put forward at committee on 10-03 and considered on 10-16. Correct the dates. Explain that secure care is an involuntary or secure-treatment approach, not harm reduction; this cuts against a "consistently advancing industry interests" narrative and should be stated. Richmond News reported the motion passed unanimously.
17 Lucy surrenders licence, November 2023 ✅ Accurate; quotations correct. Add: revocation took effect in January 2024; the company also vacated its warehouse and discontinued TerraCube.
18 Richmond News: contract ended 2023-11-16 ✅ Accurate (2024-02-20, Daisy Xiong). Heed's response must be added: "I have clarified it twice in council"; "they had absolutely nothing to do with this motion"; Heed said Lucy no longer operated in Canada and that he and his family received threatening emails; the petition had more than 8,000 signatures.
19 Naloxone motion ✅ Fully accurate. Notice 2023-11-24; passed at committee 12-04; adopted on consent by Council 12-11. None.
20 SCS motion ✅ Accurate. Notice given 2024-01-30; the original motion PDF lists "Members of Council: Laura Gillanders and Kash Heed." Passed at committee on 2-05 by 8–1 (Au opposed). Add the committee vote. Add: the motion text contains no reference to safe supply, pharmaceuticals or prescribing. Cite the original motion PDF.
21 Sing Tao report on resident "Ted" ✅ Accurate. Published 2024-02-13 09:18 (covering the 2-12 meeting), reporter Chen Yifen. ⚠️ Privacy: the minutes record this private resident's full name. Do not name him; use "a speaker." Review the Council YouTube recording to confirm what each person said.
22 2-12/13 votes; no recusal recorded ✅ Accurate. The motion to table was defeated, with Brodie, Day, Gillanders, Heed, Hobbs, McNulty and Wolfe opposed; the main motion carried 7–2 (Au and Loo opposed) on 2-13. No conflict declaration is recorded. Add: minutes are summaries, and Heed says he clarified the matter twice. Add the legal point: the contract reportedly ended about two and a half months before the motion was introduced, so a statutory conflict would depend on whether a continuing financial interest (shares, options, deferred compensation) existed at the time of the vote.
23 City statement: SCS does not hand out drugs ✅ Accurate (2024-02-20): "They do not hand out drugs to users." Add: the City cannot open an SCS; only VCH or an agency with a Health Canada section 56.1 exemption can. VCH announced on 2-14 it would not proceed with a stand-alone SCS.
Intro "Hundreds of residents attended" ✅ Broadly accurate. Sing Tao: nearly 1,000 protesters outside and 120+ registered speakers; Richmond News: about 100 residents spoke. None.

3. Key evidence to add

Verified and recommended for inclusion

S1. Connecting NGB to Kash Heed
- Vice (2018-03-28): "Heed, now a strategic consultant with licensed producer-hopeful National Green BioMed."
- The NGB Offering Memorandum shows the company's head office on Shell Road in Richmond and former federal cabinet minister Herb Dhaliwal as chairman.

S2. The NGB → M-J Milloy → Heed connection
- UBC Faculty of Medicine (2015-06-08): NGB committed $1,000,000 to UBC to fund M-J Milloy's cannabis research.
- At CannX 2018, Heed (GrowX) co-presented with Milloy.
- This is concrete evidence of the 2014–2018 overlap between commercial cannabis and harm-reduction research.

S3. Lucy's safer-supply language predates Heed
- See item 10 above. This balancing evidence must be added; without it, the implication that "Lucy hired Heed for safe supply" has no basis.

S4. FOI emails: the Premier's Office intervened in VCH's decision (Glacier Media, 2024-05-28, Graeme Wood)
- Dawar email, 2024-02-06: the committee motion "is a great opportunity to open the door for eOPS in Richmond";
- VCH deputy chief medical health officer Lysyshyn, 2-09: not recommending an SCS open to the public within the hospital;
- Morning of 2-13, the ministry communications director relayed: "the Premier's Office has directed us to direct VCH to issue a statement to quell some of the misinformation."
- Significance: this partly corroborates Heed's account that "the doctor said we could look at it," and shows VCH's final position was shaped by provincial political intervention. Global News followed up on 2024-05-29.

S5. Outcome
- 2024-02-14: VCH says it will not establish a stand-alone SCS;
- 2024-02-20: the City announces Richmond will not have a stand-alone SCS.
- The draft never reported the outcome, leaving readers to assume the SCS was still proceeding.

S6. What happened to Lucy
- Delisted from Nasdaq on 2024-06-27; trading moved to OTC from 7-01.

S7. Heed's response and circumstances
- Denies any connection, says he clarified at Council, received threatening emails (Richmond News, 2024-02-20).

S8. Current context
- Heed announced in October 2025 that he is running for Richmond mayor in 2026 (Richmond News and others). Readers are entitled to know this context.

Not yet public; worth obtaining through formal channels (would materially strengthen the evidence)

Gap How to obtain
Heed's 2023–2025 financial disclosure statements Under the Financial Disclosure Act, councillors' statements are open to public inspection; request them from the Richmond City Clerk. Note: sources of income need only be disclosed for organizations in the regional district (Metro Vancouver), so Lucy, registered in Victoria, may not appear; but shareholdings in any corporation must be disclosed with no geographic limit. If Heed held Lucy shares, they should appear.
Heed's summer-2023 communications with the VCH doctor FOI requests to VCH and the City of Richmond for May–September 2023, keywords Heed, Dawar, supervised consumption, eOPS. Glacier Media has shown such requests can succeed.
Whether Heed lobbied government for Lucy Search the BC Lobbyists Registry and the federal Registry of Lobbyists for Lucy Scientific and Heed.
Heed's clarification at the 2-12/13 meeting and his exchange with the speaker City Council YouTube archive.
Directors and shareholders of Heed Consultants Ltd. BC Registry (paid search).
Whether the GrowX transaction closed and Heed became a director SEDAR+ / TSXV bulletins.
Original Lucy contract and termination letter Can only be requested from Heed or Lucy directly (private contracts are not subject to FOI).
